ERIC Issues Comments Supporting EEOC Rule to Exempt Retiree Health Benefits from ADEA

ERIC submits comments on the proposed amendment to the EEOC’s regulations to make clear that the practice of altering, reducing, or eliminating employer-sponsored retiree health benefits when retirees become eligible for Medicare or State-sponsored retiree health benefits is exempt from the prohibitions of the Age Discrimination in Employment Act of 1967. See 68 Fed. Reg. 41,452 (July 14, 2003). As explained in the enclosed comments, ERIC strongly supports the exemption.
