Summary of Important Issues in Tittle v. Enron Court Decision (Covington & Burling - ERIC)

Amy Moore of Covington and Burling and ERIC has produced for ERIC members a chart summarizing the significant issues addressed in a recent court decision to allow employees of Enron to sue the officers, directors and plan administrators for breach of fiduciary liability
regarding the administration of the company's 401(k) retirement plans.

ERIC members have followed the Enron litigation closely out of concern that it will expand the boundaries of fiduciary liability for these plans. The side-by-side chart identifies the issues raised by the decision, and outlines the defendant's position, the Labor Department's
position and the court's decision.
