The Fate of Chevron Deference and the Future of Benefits Regulation

Under the Supreme Court’s 1984 decision in Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc., courts must uphold a regulation embodying a federal agency’s interpretation of a statutory ambiguity if the agency’s interpretation is permissible, even if the court would otherwise interpret the statute differently. This year, the Supreme Court will decide whether to abandon or severely limit this so-called “Chevron deference.” Overturning Chevron would have profound consequences for all of Administrative Law, potentially including the regulation of employee benefit plans.
